EB-1 Extraordinary Ability

While the green card process for most employment-based applicants begins with a lengthy labor market test requirement, the EB-1 Extraordinary Ability category provides an accelerated permanent residency application process for those individuals who are at the peak of their field of endeavor. What’s more, applicants who qualify for the EB-1 Extraordinary Ability do not require employer sponsorship. You may qualify for this fast-track process if you have attained recognition in your field as a result of significant original contributions, publications, patents, major awards, exclusive professional memberships, and/or employment in critical and essential roles with distinguished organizations.

Do you possess an advanced degree or a bachelor’s degree and at least 5 years of experience? Do you work in a STEM field? If so, the EB-2 National Interest Waiver (NIW) green card category may be an ideal solution for you. The NIW route offers many benefits, including waiving the normal labor market test requirement, allowing applicants to apply without employer sponsorship, and applying to a much larger population than the EB-1 route (NIW does not require any publications, patents, awards, etc.).
